TERMS OF SERVICE AGREEMENT

IMPORTANT NOTICE TO USER: PLEASE READ THIS DOCUMENT CAREFULLY. This Terms of Service (“Agreement”) is a legal agreement between you (referred to herein as “you” or “your”) and @radical.media LLC (“Radical”, “we”, “our”, or “us”) for access to and use of our website available at www.thewildernessdowntown.com (the “Website”) and related software and services (referred to collectively as the “Services” and excluding any services provided to you by Radical under a separate written agreement).

YOU MUST ACCEPT THIS TERMS OF SERVICE AGREEMENT BEFORE ACCESSING OR OTHERWISE USING THE SERVICES. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THE AGREEMENT, DO NOT ACCESS OR USE THE SERVICES.

YOU REPRESENT THAT YOU HAVE THE LEGAL AUTHORITY TO ENTER INTO THIS AGREEMENT AND TO BE BOUND BY ITS TERMS.

1. The Services.
The Services are an interactive art project in the manner of a music video. In order to use some of the features that are offered through the Services, you must provide certain information, such as address information. Certain features and functionality of the Services related to mapping and satellite imagery are provided by Google, Inc. By using the Services, you also agree to be bound by Google, Inc.’s Terms of Use, and further agree that your Content (as defined in Section 7 below) shall at all times conform with Google, Inc.’s Chrome Experiments Terms of Service and Community Guidelines, as such terms of service and/or community guidelines may be modified by Google, Inc. from time to time. Although certain features and functionality of the Services are powered by Google, Inc.’s technology, we are not collecting any information on behalf of Google, Inc. or its affiliates.

2. Use of Services by You.
A. You acknowledge and agree that Radical makes no representation or warranty regarding Content on the Services.

B. You represent and warrant to us that you will use the Services solely for your own, non-commercial, personal use for your own account.

C. The Services may contain features and functionalities that may link you or provide you with access to third party content, including websites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services not controlled by Radical. Your use of third party Content found on or through the Services, including any terms, conditions, warranties or representations associated therewith, are solely between you and third party. You agree that Radical shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

D. You acknowledge and agree that, subject to the disclaimer of warranties and limitation of liability set forth in this Agreement, your use of the Services, including, without limitation, the storage of any data, files, information and/or other materials on a server owned or under the control of Radical or in anyway connected to the Services, shall be at your sole risk and responsibility and Radical shall have no obligation to back-up such data, files, information and/or other materials. Radical expressly reserves the right to limit storage capacity and to remove and/or delete any data, files, and/or other information stored or used in connection with the Services that Radical deems, in its sole discretion, to be in violation of this Agreement and/or any local, state, or federal law or regulation.

E. You shall not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).

F. You shall not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose.

G. You are solely responsible for (and Radical has no responsibility to you or to any third party for) any breach of your obligations under this Agreement and for the consequences (including any loss or damage which Radical may suffer) of any such breach.

H. You acknowledge and agree that Radical has no control over the conduct of Website users or the truth, accuracy, completeness or authenticity of the information that users post on our Services.

3. Restrictions on Use of Services. You agree that you will not:
(i) use the Services in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this Agreement and/or any and all applicable local, state and federal laws and regulations and international treaties;

(ii) use the Services for the distribution, housing, processing, propagation, storage, or otherwise handling in any way abusive, defamatory, harassing, libelous, lewd, libelous, obscene, pornographic, threatening, or tortuous material, or any false or misleading material, or any other material (including links to such material) that Radical deems, in its sole discretion, to be objectionable whether or not such material is unlawful;

(iii) use the Services to export data in violation of applicable U.S. laws or regulations;

(iv) sell, rent, lease, loan, distribute, transfer, sublicense, or otherwise permit any third party to use or have access to the Services for any purpose (except as expressly permitted by Radical in writing), whether by timesharing, service bureau, networking or any other means;

(v) remove any copyright, trademark, patent or other proprietary notices from the Services or any portion thereof;

(vi) distribute, publish, exhibit, or otherwise use the Services, or any portion thereof, in any manner and for any purpose not expressly permitted under this Agreement;

(vii) frame or utilize framing techniques to enclose the Services, or any portion thereof;

(viii) exploit the Services or collect any data incorporated in the Services in any automated manner through the use of bots, metaspiders, crawlers or any other automated means;

(ix) post hyperlinks to commercial services or websites;

(x) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;

(xi) collect personal data about other users for commercial or unlawful purposes;

(xii) post non-local or otherwise irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;

(xiii) attempt to gain unauthorized access to our computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service; or

(xiv) post, e-mail or make available Content that that constitutes or contains “affiliate marketing,” “link referral code,” “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or unsolicited commercial advertisement.

4. Provision of Services by Radical.
Radical is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Services which Radical provides may change from time to time without prior notice to you. As part of this continuing innovation, you acknowledge and agree that Radical may decline to provide you access to the Services or stop (permanently or temporarily) providing the Services (or any features or programs within the Services) to you or to users generally at Radical’s sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform Radical when you stop using the Services. You acknowledge and agree that if Radical disables access to certain features or functionalities of the Services, you may be prevented from accessing Content that another user may have intended for you.

5. Access to Services; Reservation of Rights.
A. Radical hereby gives you a personal, worldwide, non-assignable and non-exclusive right to access and use the Services in the manner and for the purposes expressly permitted by the Agreement. You agree not to copy, decompile, reverse engineer, disassemble, modify, create a derivative work of, display in human readable form, attempt to discover any source code, or otherwise use any software that enables or comprises any part of the Services. You may not assign (or grant a sub-license of) your rights to use the Services, grant a security interest in or over your rights to use the Services, or otherwise transfer any part of your rights to use the Services and any such attempt shall be null and void at the time of such attempt.

B. Radical reserves all right, title and interest in and to the Services not expressly granted to you under this Agreement, including, without limitation, all patent rights, copyrights, trademarks, trade names, trade secrets, trade dress and other intellectual property and proprietary rights. There are no implied licenses under this Agreement.

6. Your Submissions Are Not Confidential.
You agree and understand that messages and other Content submitted by you are not private or secure and may be viewable by persons other than intended recipients. You agree not to submit to us via the Website any Content that you wish to keep private.

7. Content in the Services.
A. You understand that all information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such content originated. All such information is referred to as the “Content”.

B. You acknowledge that Content presented to you as part of the Services is protected by intellectual property rights which are owned by third parties who provide that Content to Radical (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told that you may do so by Radical or by the owners of that Content, in writing.

C. Radical reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all Content.

D. You understand that by using the Services you may be exposed to Content that you may find offensive, indecent or objectionable and that, in this respect, you use the Services at your own risk.

E. You agree that you are solely responsible for (and that Radical has no responsibility to you or to any third party for) any Content that you create, transmit or display while using the Services and for the consequences of your actions (including any loss or damage which Radical may suffer) by doing so.

8. Intellectual Property.
A. You acknowledge and agree that Radical (or Radical’s licensors) own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). The Services include, without limitation, all rights with respect to copyrights, patents, trademarks, service marks, moral rights, trade names, domain names, technology, mask works, know-how, design rights, trade dress, trade secrets, inventions, ideas, processes, formulas, source code and object code, data, and similar rights including the information in any application, registration, or renewal thereof that may be protected under the intellectual property laws, regulations, or rules of any country. Without limiting the foregoing, all data, graphics, icons, images, logos, text, and the compilation of all content therein, and all service marks, trademarks, trade names, and trade dress depicted on the Services are owned by Radical (or Radical’s licensors).

B. You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) which may be affixed to or contained within the Services.

C. You agree that in using the Services, you will not use any trademark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.

9. Content License from you.
A. You retain copyright and any other rights you already hold in Content which you submit, post or display on or through, the Service. By submitting, posting or displaying the Content you give Radical a worldwide, perpetual, irrevocable, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display, distribute, sublicense (through multiple tiers), and otherwise exploit any Content which you submit or post on or through the Services in any manner or media whatsoever, now known or hereafter developed.

B. In connection with Content you submit to the Services, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize Radical to use such Content in the manner contemplated by the Services and these Terms of Service. You further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have written permission from their rightful owner to post the material and to grant Radical all of the license rights granted herein.

C. You understand that Radical, in performing the required technical steps to provide the Services to our users, may (a) transmit or distribute your Content over various public networks and in various media; and (b) make such changes to your Content as are necessary to conform and adapt that Content to the technical requirements of connecting networks, devices, services or media. You agree that this license shall permit Radical to take these actions.

D. You confirm and warrant to Radical that you have all the rights, power and authority necessary to grant the above license.

10. Copyright Agent.
The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe that your work has been copied and posted on the Services in a way that constitutes copyright infringement, please provide our copyright agent with the following information: an electronic or physical signature of the copyright owner or of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Services; your address, telephone number, and e-mail address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf. Any notification by a copyright owner or a person authorized to act on such copyright owner’s behalf that fails to comply with requirements of the DMCA shall not be considered sufficient notice and shall not be deemed to confer upon Radical actual knowledge of facts or circumstances from which infringing material or acts are evident. 11. Privacy Policy.

This policy explains how Radical treats your personal information, and protects your privacy, when you use the Services. You agree to the use of your data in accordance with Radical’s privacy policy.

12. Changes to Agreement.
Radical reserves the right to change, amend and/or modify this Agreement, in whole or in part, at any time with or without notice. You hereby acknowledge and agree that such changes, amendments and/or modifications will become effective when posted on the Services or as otherwise provided by Radical. From time to time, Radical may post on the Website or otherwise notify you of additional or different rules and policies relating to the Services. These rules and policies shall thereafter be part of this Agreement. If you use the Services after the posting or other notice of changes in this Agreement or changed rules or policies, you are agreeing to follow and be bound by them for such use.

13. NO WARRANTIES.
THE SERVICES ARE PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND. WE HAVE NO CONTROL OVER AND MAKE NO REPRESENTATIONS AS TO THE TRUTH OR ACCURACY OF USER GENERATED CONTENT. TO THE FULLEST EXTENT PERMITTED BY LAW, RADICAL EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, AND/OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, RADICAL DOES NOT WARRANT THE ACCURACY, RELIABILITY OR COMPLETENESS OF ANY INFORMATION PROVIDED BY RADICAL IN CONNECTION WITH YOUR USE OF THE SERVICES, NOR THAT THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY DATA, FILES, AND/OR OTHER INFORMATION STORED ON A SERVER OWNED OR UNDER THE CONTROL OF RADICAL OR IN ANY WAY CONNECTED WITH THE SERVICES, WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE OR SECURE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN DISCLAIMERS OR LIMITATIONS OF WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR REPUBLICATION OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM RADICAL OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE AGREEMENT.

14. LIMITATION OF LIABILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RADICAL, ITS AFFILIATES, DIRECTORS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS OR THIRD PARTY LICENSORS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES OR LOSSES ARISING OUT OF OR RELATING TO THIS AGREEMENT AND/OR THE SERVICES PROVIDED HEREUNDER, EVEN IF RADICAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, NEGLIGENCE, RECKLESSNESS, PROFESSIONAL NEGLIGENCE, TORT, STRICT LIABILITY OR ANY OTHER BASIS OR LEGAL THEORY. SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER OR NOT THE DAMAGES ARISE DIRECTLY OR INDIRECTLY FROM: (i) THE USE OR MISUSE OF, OR RELIANCE UPON, THE SERVICES PROVIDED HEREUNDER; (ii) THE INABILITY TO USE THE SERVICES FOR ANY REASON, INCLUDING, WITHOUT LIMITATION, FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION, OR ANY FAILURE OF PERFORMANCE NOT LIMITED TO ACTS OF GOD, COMMUNICATION FAILURE, THEFT, OR DESTRUCTION; (iii) THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICES; OR (iv) THE DELETION AND/OR CORRUPTION OF ANY DATA, INFORMATION, DOCUMENTS, FILES AND/OR ANY OTHER MATERIALS STORED ON A SERVER OWNED OR UNDER THE CONTROL OF RADICAL OR IN ANY WAY CONNECTED TO THE SERVICES. SUCH LIMITATION ON LIABILITY SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.

15. Indemnification.
You agree to release, indemnify and hold harmless Radical, its affiliates, directors, members, officers, employees, agents and third party licensors, from and against any and all liabilities, losses, damages, claims and expenses, including attorneys’ fees, with respect to your use or misuse of, or reliance upon, the Services or your violation of this Agreement or rights of another or with respect to any Content you submit or make available through the Services. This section shall survive the termination of this Agreement.

16. Release.
You acknowledge that Radical may license your Content to licensees, including without limitation, the band Arcade Fire, for use in connection with musical and/or commercial activities of a public nature, and you consent to any such use without any compensation to you. You hereby release Radical (and our officers, directors, members, managers, employees, agents and affiliates) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with our use of Content submitted by you to us, or our licensees’ use of such Content.

If you are a California resident, you waive California Civil Code 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

17. Term and Termination.
This Agreement is effective until terminated by Radical or you. Radical shall have the right to terminate this Agreement including, without limitation, your right to access and use the Services, at any time in Radical’s sole discretion and without advance notice to you. The licenses granted herein by Radical to you shall automatically terminate without advance notice if you fail to comply with any material provision of this Agreement. Upon termination of this Agreement for any reason, you shall immediately cease using the Services.

18. Governing Law and Venue.
This Agreement shall be governed by the laws of the State of New York without giving effect to conflict or choice of law principles, and any litigation between the parties arising under this Agreement shall be conducted exclusively in state or federal courts located in the State and City of New York. The parties agree that “United Nations Convention on Contracts for the International Sale of Goods” shall not apply to this Agreement.

19. Severability.
If any provision in this Agreement is invalid or unenforceable or contrary to applicable law, such provision shall be construed, limited, or altered, as necessary, to eliminate the invalidity or unenforceability or the conflict with applicable law, and all other provisions of this Agreement shall remain in effect.

20. No Assignment, Sublicense or Transfer.
You may not assign, sublicense, or transfer this Agreement or any rights or obligations hereunder without prior written consent of Radical. Any such attempted assignment, sublicense, or transfer will be null and void and Radical, in its sole discretion, shall have the right to immediately terminate this Agreement.

21. Beta.
The Services are being made available to you as part of a beta program for trial and evaluation (“Beta Services”). You acknowledge and agree that such Beta Services: (i) are provided for evaluation purposes only; (ii) may change or cease to be functional without notice at the sole discretion of Radical; and (iii) shall not create any obligation for Radical to continue to develop, support, repair, offer for sale, or in any other way continue to provide to you or to any other party the Services.

22. Entire Agreement.
This Agreement sets forth the entire understanding and agreement between the parties relating to its subject matter and may be amended only in a writing signed by both parties. Any waiver of or promise not to enforce any right under this Agreement shall not be enforceable unless evidenced by a writing signed by the party making said waiver or promise. ANY TERMS AND CONDITIONS OF ANY DOCUMENT SUBMITTED BY YOU IN CONNECTION WITH THE SERVICES THAT ARE IN ADDITION TO, DIFFERENT FROM, OR INCONSISTENT WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT ARE NOT BINDING ON RADICAL AND ARE INEFFECTIVE. NO VENDOR, DISTRIBUTOR, DEALER, RETAILER, AGENT, SALES PERSON, OR OTHER PERSON IS AUTHORIZED BY RADICAL TO MODIFY THIS AGREEMENT OR TO MAKE ANY WARRANTY, REPRESENTATION, OR PROMISE THAT IS DIFFERENT THAN OR IN ADDITION TO THE WARRANTIES, REPRESENTATIONS, OR PROMISES EXPRESSLY SET FORTH IN THIS AGREEMENT.

Google Maps/Earth Terms of Service

By downloading, installing, or using the Google Earth software, accessing or using the Google Maps service (together, the “Products” or “Services”), or accessing or using any of the content available within the Products, you agree to be bound by the following: (1) the Google Terms of Service (the “Universal Terms”); (2) the terms found on our Legal Notices page (the “Legal Notices”); and (3) the additional terms and conditions set forth below (the “Additional Terms”). Before you continue, you should read each of these three documents, as together they form a binding agreement between you and Google regarding your use of the Products. Collectively, the Universal Terms, the Legal Notices, and the Additional Terms are referred to as the “Terms”.

As a condition of downloading, accessing, or using the Products, you also agree to the terms of the Google Privacy Policy.

1. Use of the Products. Google grants you a non-exclusive, non-transferable license to access the Google Maps service, to download and use the Google Earth software and service, and to access the Content (as defined below) within the Products and according to the Terms.

2. Restrictions on Use. Unless you have received prior written authorization from Google (or, as applicable, from the provider of particular Content), you must not:
(a) access or use the Products or any Content through any technology or means other than those provided in the Products, or through other explicitly authorized means Google may designate (such as through the Google Maps/Google Earth APIs);
(b) copy, translate, modify, or make derivative works of the Content or any part thereof;
(c) redistribute, sublicense, rent, publish, sell, assign, lease, market, transfer, or otherwise make the Products or Content available to third parties;
(d) reverse engineer, decompile or otherwise attempt to extract the source code of the Service or any part thereof, unless this is expressly permitted or required by applicable law;
(e) use the Products in a manner that gives you or any other person access to mass downloads or bulk feeds of any Content, including but not limited to numerical latitude or longitude coordinates, imagery, and visible map data;
(f) delete, obscure, or in any manner alter any warning, notice (including but not limited to any copyright or other proprietary rights notice), or link that appears in the Products or the Content; or
(g) use the Service or Content with any products, systems, or applications for or in connection with (i) real time navigation or route guidance, including but not limited to turn-by-turn route guidance that is synchronized to the position of a user’s sensor-enabled device; or (ii) any systems or functions for automatic or autonomous control of vehicle behavior.

3. Appropriate Conduct; Compliance with Law and Google Policies. You agree that you are responsible for your own conduct and content while using the Products, and for any consequences thereof. You agree to use the Products only for purposes that are legal, proper and in accordance with the Terms and any applicable policies or guidelines Google may make available. By way of example, and not as a limitation, you agree that when using the Products or the Content, you will not:
(a) defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
(b) upload, post, email, transmit or otherwise make available any inappropriate, defamatory, obscene, or unlawful content;
(c) upload, post, transmit or otherwise make available any content that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party, unless you are the owner of the rights, or have the permission of the owner or other legal justification to use such content;
(d) upload, post, email, transmit or otherwise make available messages that promote pyramid schemes, chain letters, or disruptive commercial messages or advertisements;
(e) upload, post, email, transmit or otherwise make available any other content, message, or communication prohibited by applicable law, the Terms or any applicable Product policies or guidelines;
(f) download any file posted by another that you know, or reasonably should know, cannot be legally distributed in such manner;
(g) impersonate another person or entity, or falsify or delete any author attributions or proprietary designations or labels of the origin or source of Content, software or other material;
(h) restrict or inhibit any other user from using and enjoying the Products or Google services;
(i) interfere with or disrupt Google services or servers or networks connected to Google services, or disobey any requirements, procedures, policies or regulations of networks connected to Google services;
(j) use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of the Google services or Content, or collect information about users for any unauthorized purpose;
(k) submit content that falsely expresses or implies that such content is sponsored or endorsed by Google;
(l) create user accounts by automated means or under false or fraudulent pretenses;
(m) promote or provide instructional information about illegal activities;
(n) promote physical harm or injury against any group or individual; or
(o) transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

4. Content in the Products. Google Maps and Google Earth allow you to access and view a variety of content, including but not limited to photographic imagery, map and terrain data, business listings, reviews, traffic, and other related information provided by Google, its licensors, and its users (the “Content”). Additionally, you may choose to access other third party content made available in the Products through Google services such as Google Gadgets. You understand and agree to the following:
(a) Map data, traffic, directions, and related Content are provided for planning purposes only. You may find that weather conditions, construction projects, closures, or other events may cause road conditions or directions to differ from the map results. You should exercise judgment in your use of this Content.
(b) By using the Products, you do not receive any, and Google and/or its licensors and users retain all ownership rights in the Content. You may not use, access or allow others to use or access the Content in any manner not permitted under the Terms, unless you have been specifically permitted to do so by Google or by the owner of that Content, in a separate agreement.
(c) Certain Content is provided under license from third parties, including but not limited to Tele Atlas B.V. (”Tele Atlas”), and is subject to copyright and other intellectual property rights owned by or licensed to Tele Atlas and/or such third parties. You may be held liable for any unauthorized copying or disclosure of this Content. Your use of Tele Atlas Content, including but not limited to printing or use in marketing or promotional materials, is subject to additional restrictions located in the Legal Notices page.

5. Additional Terms for Google Earth.
(a) Export Restrictions. The Google Earth software is subject to United States export controls. By using the Google Earth software, you agree to use the software only for purposes that are legal, proper and in accordance with these Terms. Specifically, you agree to comply with all applicable export and reexport control laws and regulations, including the Export Administration Regulations (”EAR”) maintained by the U.S. Department of Commerce, and trade and economic sanctions maintained by the Treasury Department’s Office of Foreign Assets Control.

8. Content in the Services

This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Google, in the manner permitted by the Terms.

10.2 You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically told that you may do so by Google, in writing.

10.3 Unless Google has given you specific written permission to do so, you may not assign (or grant a sub-licence of) your rights to use the Software, grant a security interest in or over your rights to use the Software, or otherwise transfer any part of your rights to use the Software.

11. Content licence from you

11.1 You retain copyright and any other rights you already hold in Content which you submit, post or display on or through, the Services. By submitting, posting or displaying the content you give Google a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive licence to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute any Content which you submit, post or display on or through, the Services. This licence is for the sole purpose of enabling Google to display, distribute and promote the Services and may be revoked for certain Services as defined in the Additional Terms of those Services.

11.2 You agree that this licence includes a right for Google to make such Content available to other companies, organisations or individuals with whom Google has relationships for the provision of syndicated services, and to use such Content in connection with the provision of those services.

13. Ending your relationship with Google

13.1 The Terms will continue to apply until terminated by either you or Google as set out below.

13.2 If you want to terminate your legal agreement with Google, you may do so by (a) notifying Google at any time and (b) closing your accounts for all of the Services which you use, where Google has made this option available to you. Your notice should be sent, in writing, to Google’s address which is set out at the beginning of these Terms.

13.3 Google may at any time, terminate its legal agreement with you if:

(B) Google is required to do so by law (for example, where the provision of the Services to you is, or becomes, unlawful); or

(C) the partner with whom Google offered the Services to you has terminated its relationship with Google or ceased to offer the Services to you; or

(D) Google is transitioning to no longer providing the Services to users in the country in which you are resident or from which you use the service; or

(E) the provision of the Services to you by Google is, in Google’s opinion, no longer commercially viable.

13.4 Nothing in this Section shall affect Google’s rights regarding provision of Services under Section 4 of the Terms.

13.5 When these Terms come to an end, all of the legal rights, obligations and liabilities that you and Google have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of paragraph 20.7 shall continue to apply to such rights, obligations and liabilities indefinitely.

14. Exclusion of Warranties

14.1 The Services are provided “as is” and Google, its Subsidiaries and Affiliates, and its licensors give you no warranty with respect to them.

14.2 In particular, Google, its Subsidiaries and Affiliates, and licensors do not represent or warrant to you that:

(A) your use of the Services will meet your requirements,

(B) your use of the Services will be uninterrupted, timely, secure or free from error,

(C) any information obtained by you as a result of your use of the Services will be accurate or reliable, and

(D) that defects in the operation or functionality of any Software provided to you as part of the Services will be corrected.

14.3 No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the Services except to the extent that they are expressly set out in the Terms.

14.4 Nothing in the Terms shall affect those statutory rights which you are always entitled to as a consumer and that you cannot contractually agree to alter or waive.

15. Limitation of Liability

15.1 Nothing in these Terms shall exclude or limit Google’s liability for losses which may not be lawfully excluded or limited by applicable law.

15.2 Subject to overall provision in paragraph 15.1 above, Google, its Subsidiaries and Affiliates, and its licensors shall not be liable to you for:

(A) any indirect or consequential losses which may be incurred by you. This shall include any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, or any loss of data suffered by you;

(B) any loss or damage which may be incurred by you as a result of:

(i) any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Services;

(ii) any changes which Google may make to the Services, or for any permanent or temporary cessation in the provision of the Services (or any features within the Services);

(iii) the deletion of, corruption of, or failure to store, any Content and other communications data maintained or transmitted by or through your use of the Services;

(iii) your failure to provide Google with accurate account information;

(iv) your failure to keep your password or account details secure and confidential;

15.3 The limitations on Google’s liability to you in paragraph 15.2 above shall apply whether or not Google has been advised of or should have been aware of the possibility of any such losses arising.

16. Copyright and trade mark policies

16.1 It is Google’s policy to respond to notices of alleged copyright infringement that comply with applicable international intellectual property law (including, in the United States, the Digital Millennium Copyright Act) and to terminating the accounts of repeat infringers. 19. Changes to the Terms

19.1 Google may make changes to the Universal Terms or Additional Terms from time to time. When these changes are made, Google will make a new copy of the Universal Terms available at http://www.google.com/accounts/TOS?hl=en and any new Additional Terms will be made available to you from within, or through, the affected Services.

19.2 You understand and agree that if you use the Services after the date on which the Universal Terms or Additional Terms have changed, Google will treat your use as acceptance of the updated Universal Terms or Additional Terms.

20. General legal terms

20.7 The Terms, and your relationship with Google under the Terms, shall be governed by English law. You and Google agree to submit to the exclusive jurisdiction of the courts of England to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Google shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

Lass dir auf YouTube nichts zu Schulden kommen.
Poste keine Videos mit unangemessenem Content wie Misshandlungen von Tieren, Drogenmissbrauch oder Anleitungen zum Bau einer Bombe.
Das Zeigen drastischer oder grundloser Gewalt ist nicht gestattet. Wenn eine Person in deinem Video körperlich verletzt, attackiert oder erniedrigt wird, darfst du es nicht posten.
YouTube ist keine Website, die schockieren soll. Poste keine Videos von schlimmen Unfällen, Toten oder Ähnlichem.

Teile anderen deine Meinung mit, denn Feedback gehört einfach dazu. Mit ernsthaften und respektvollen Kommentaren kannst du Freunde gewinnen, Geschichten weitererzählen und YouTube noch intensiver nutzen. Poste Kommentare, bewerte Videos, drehe deine eigenen Antworten zu Videos, die dich bewegen, und nimm an Wettbewerben teil. Hier gibt es immer was zu tun.
Möglicherweise gefällt dir nicht alles, was du siehst. Einige Inhalte können beleidigend auf dich wirken. Wenn du der Meinung bist, dass ein Video gegen unsere Nutzungsbedingungen verstößt, klicke unter dem Video auf die Schaltfläche “Melden”, um es von den YouTube-Mitarbeitern überprüfen zu lassen. Wenn es nicht dagegen verstößt, sieh dir einfach etwas anderes an. Warum seine Zeit mit Videos verschwenden, die man nicht mag?

ich kann mich erinnern, wenn man früher versuchte, einen schmierigen winkeladvokaten darzustellen, war es jemand, der einem mit einem dicken st0ß akten vor der nase rumwedelte, einem schnaufend versicherte, daß man das überhaupt nicht lesen müße, das übliche eben, er hat das alles schon gecheckt, alles zu meinem besten. mit dem daumen kleingeschriebene zeilen verdeckend, einem, nach schweiß, tabak und zwiebeln riechend, auf die pelle rücken. wie fühlt sich sowas heute an, am browser in chrome oder aluminium?

btw: google hat was neues, um adressen zu sammeln: The wilderness downtown. dort muß man das lesen, um eine wirklich coole Postkarte eines wirklich coolen Musikvideos abzusenden. supersache. Kosten des Musikvideos: weiß nicht, teuer. Einnahmen aus dem verticken der infos an die industrie: mehr. Imagegewinn durch coole band und cooles video: unbezahlbar. win, win, google.

6000 Bomber für den Frieden

Einen alten ARD Bericht habe ich gestern online gesehen. Ah, erst über Gebühren meckern und dann doch in der ersten Reihe. Leider war der Bericht aus 2001, mit einem sichtlich überfordertem Rudolf Scharping. Und genau das ist der Punkt, kein Politiker würde sich heute von den öffentlich-rechtlichen mehr so in die Enge treiben lassen wie damals unser radfahrender Sozialdemokrat. Die Guttenbergs von heute bügeln unangenehme Fragen einfach weg, zum einen, und zum anderen ist da kaum noch jemand, der solche Fragen stellt. Eine Krähe hackt der anderen kein Auge aus, oder ein Steffen Seibert plant schon mal die Zukunft als Regierungssprecher, wenn er im heute Journal noch die Wahrheit verkündet. Ein geschlossenes System, KochTV. Es ging um den Kosovo oder besser gesagt um den sogenannten Balkankonflikt und wie eben genannter Scharping Tafel um Tafel mit Fotos serbischer, ethnischer Reinigung in die Kamera hielt, um ein Eingreifen der Nato, und vor allem Deutschlands, in den Konflikt zu legitimieren. ich will hier keine Kriegsverbrechen verteidigen, aber der Bericht konnte ziemlich lückenlos beweisen, das alle aufgeführten Gründe Scharpings, Deutschland in den Krieg zu ziehen, schlicht nicht stimmten, glatt Lüge waren. ich kannte eigentlich schon das gefakte TimeCover, bei dem Journalisten aus einem Stacheldrahtverhau heraus ein Interview führten, dabei mit der Kamera immer wieder auf einen, mit einem Geburtsfehler behafteten Mann zielten und das dann als Reportage aus einem Serbischen Konzentrationslager verkauften. Unbestritten, im ehemaligen Jugoslawien herrschte Bürgerkrieg, UCK vs Serben, kein Spaß, aber wenn ich 6000 NatoBombenangriffe mit Bildern eines Exodus verteidige, den ebenjene ausgelöst hatten, ist das schon mehr als fragwürdig. Der Bericht ging auch der Frage nach, was denn nun eigentlich der wahre Grund für das Eingreifen der NATO war: Die Rechtfertigung der Nato weiter zu existieren, zu zeigen, das auch nach dem Ende des kalten Krieges ein waffenstrotzendes Bündnis nötig ist, die demokratische Freiheit zu verteidigen. Und, so simpel das klingen mag, den Boden für Deutschland zu bereiten, um nach 50jähriger Abstinenz auch mal wieder auf den Kriegsschauplätzen der Welt mitzumischen. Funktioniert hat das ganz gut, verteidigen wir doch jetzt Deutschland auch am Hindukusch. Noch einwas fiel mir auf: Scharpings Beweisführung erinnerte mich stark an Colin Powell vor der UNO, die Massenvernichtungswaffennummer. Wann begann eigentlich das letzte Mal ein Krieg NICHT mit einer LÜGE?

Introduktion

Nachdem hier forever nichts passiert ist und auch vorher nur mehr oder weniger sporadisch das ein oder andere Foto hochgeladen wurde, möchte ich nun “endlich” das hier tun, was man gemeinhin auf einem blog tun, nämlich schreiben. schreiben vor allem über Dinge, mit denen ich mich im letzten Jahr hauptsächlich beschäftigt habe, und das war nicht etwa Design, sondern eher Politik, oder besser die Zusammenhänge dahinter, oder davor, oder wie man auch immer das sehen will. Und ich habe gesehen, wie ein Freund angefangen hat, und wie sich das schon nach ein paar tagen so schön entwickelt hat, das ich mich schon auf den nächsten eintrag freue ( http://cellolitis.wordpress.com/ ). Es gibt soviel, was da täglich auf uns einstürmt oder sollte man sagen eingestürmt wird, das ich mich nicht unbedingt auf Tagespolitik beziehen will, Tagespolitik ist der Tod anyway, wer will diesem Gerangel guten Gewissens folgen, ist doch dieses inszenierte Theater doch eigentlich der Grund, weshalb sich immer mehr Leute davon abwenden. Und eigentlich, Politik ist glaube ich doch überhaupt nicht der Punkt, es geht um viel mehr, Gesellschaft, System, Soziologie, und erwähnte Zusammenhänge. Aber wir fangen ganz langsam und vorsichtig an.

ok, wo anfangen, es gibt so viel.. aber eins fällt mir schon mal ein: hat irgendjemand mitbekommen, das, so eher nebenbei, ja, so macht man das heute, eine Fernsehsteuer eingeführt wurde. das sich die Ministerpräsidenten mal eben so darauf geeinigt haben, in Zukunft von jedem Haushalt zu kassieren, ob dort ein Fernseher, ein Computer oder gar kein elektrischer Strom vorhanden ist, spielt hierbei keine Rolle. Nun hätte ich erwartet, daß das in irgendeiner Form eine Reaktion auslöst, zum Beispiel in den Medien, die nicht eh schon in diesen Pott langen. aber: Nein, nichts, das einzige, was ich fand, in Spiegel, Süddeutsche und, da fiels mir bald von sonstwo, Taz, einhellige Freude darüber, das nun die bösen GEZ Kontrolleure nicht mehr kommen. Da wurde in Erinnerungen geschwelgt, wie das damals war, den g-e-zler auszutricksen und trotzdem fernsehen zu kucken. Was bitte ist das für ein Bullshit, natürlich kommt jetzt keine Gezapo mehr, wozu auch, jetzt bezahlt ja jeder. Aber daß das Fernsehen eigentlich gerade auf dem Weg in die Jagdgründe ist, das immer mehr Leute sich, ob aus Protest, innerer Einstellung oder einfach nur Langeweile und dem schleichenden Gefühl von Ekel bei einem Großteil der vorgesetzten Fersehkost, abwenden und ihre Geräte dorthin geben, wo sie hingehören, nämlich auf den Sondermüll, spielt keine Rolle. Von den halbherzigen Onlinebemühungen ganz zu schweigen, auch hier wird die Gleichschaltung immer schwieriger. Nein, das alles spielt keine Rolle, denn hier soll die Kuh gemolken werden, solange sie noch nicht kollabiert. Und einmal in die Wege geleitet, glaubt doch sicher niemand, das es in drei, vier Jahren oder so eine Studie gibt, die sagt, hey, nur noch 20% der Bevölkerung überhaupt nutzen die öffentlich-rechtlichen, lasst uns zusammensetzen und die Gebühr zurücknehmen. Zahlen wir nicht jetzt noch eine Sektsteuer, die den ersten Weltkrieg finanzieren sollte. Prost.
